Terms of Service

Welcome to OfficeCup USA. These Terms of Service ("Terms") govern your access to and use of the OfficeCup USA website, prediction game, and related services (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

OfficeCup USA provides a free-to-play soccer prediction game that organizations can run for their members. Participants make predictions about matches and earn points based on published scoring rules, competing on a leaderboard. OfficeCup USA is an independent product and is not affiliated with, endorsed by, or sponsored by FIFA or any official tournament organizer.

2. Not gambling; no wagering

The Service is a social and engagement product, not a betting, wagering, lottery, or gambling service. Participation is always free of charge to participants. OfficeCup USA does not accept entry fees, does not handle stakes, and does not pay out cash prizes. Any prize, gift, or reward associated with a pool is determined and awarded solely by the organizing company or group, at its own discretion and expense, independently of OfficeCup USA. Organizers are responsible for ensuring any prizes they offer comply with applicable laws.

3. Eligibility and accounts

You must be at least 18 years old to use the Service. You agree to provide accurate information and to keep your account credentials secure. You are responsible for activity that occurs under your account. Pool administrators are responsible for managing their pools and the participants they invite.

4. Plans, fees, and invoicing

Organizations pay a one-time fee per tournament based on the plan selected. Fees are stated on our website and are due as set out in the applicable invoice or order. Unless required by law or expressly stated otherwise, fees are non-refundable once a pool has been activated. We may update pricing for future tournaments.

5. Acceptable use

You agree not to: use the Service for unlawful purposes; cheat, manipulate, or tamper with scoring or leaderboards; upload content you do not have the right to use; harass other users; attempt to gain unauthorized access to the Service; or interfere with its operation. We may suspend or terminate access for violations.

6. Organizer content and branding

If you upload a logo, colors, or other branding, you represent that you have the right to use it and you grant OfficeCup USA a limited license to display it within your pool for the purpose of providing the Service. You remain responsible for your content.

7. Intellectual property

The Service, including its software, design, and trademarks, is owned by OfficeCup USA and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You may not copy, modify, or create derivative works of the Service except as permitted.

8. Sports data and availability

Match schedules, scores, and results are obtained from third-party data providers and may contain errors or delays. We do not guarantee the accuracy, completeness, or timeliness of such data, or that the Service will be uninterrupted or error-free. Scoring is based on the data available to us and on our published rules.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, OfficeCup USA and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid to us for the applicable plan.

11. Indemnification

You agree to indemnify and hold harmless OfficeCup USA from claims, damages, and expenses arising out of your misuse of the Service, your content, your violation of these Terms, or your violation of any law or third-party right.

12. Termination

We may suspend or terminate access to the Service at any time for any reason, including violation of these Terms. Provisions that by their nature should survive termination will survive.

13. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. (Confirm the appropriate state with your attorney based on where the business is established.) Any disputes will be resolved in the state or federal courts located in that jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
